Nutzungsbedingungen für LearnDeck

1. Anbieter und Geltungsbereich

Diese Bedingungen regeln die Nutzung der App LearnDeck für iOS und iPadOS, angeboten von der 40° GmbH – Labor für Innovation, Marienthaler Straße 17, 24340 Eckernförde, support@learndeck.app.

Der Kaufvertrag über ein Abonnement kommt nicht mit dem Anbieter, sondern mit Apple zustande. Für den Kauf gelten zusätzlich die Nutzungsbedingungen von Apple für Medien und Dienste. Diese Bedingungen regeln die Nutzung der App selbst.

2. Nutzungsrecht

Sie erhalten ein einfaches, nicht übertragbares Recht, die App auf den Geräten zu nutzen, die Ihrer Apple-ID zugeordnet sind. Die App darf nicht zurückentwickelt, verändert, weiterverkauft oder vermietet werden. Alle Rechte an der Software bleiben beim Anbieter.

3. Kostenlose Version und LearnDeck Pro

Die App ist kostenlos nutzbar und in diesem Fall im Umfang begrenzt:

• 1 Sammlung
• 10 Decks
• 5 Seiten je gescanntem oder importiertem Dokument

Mit LearnDeck Pro entfallen diese Begrenzungen. Bereits erstellte Inhalte bleiben immer zugänglich, auch wenn ein Abonnement endet: die Grenzen betreffen nur das Anlegen neuer Inhalte.

4. Abonnement, Laufzeit und Kündigung

LearnDeck Pro ist ein automatisch verlängerndes Jahresabonnement. Maßgeblich ist der Preis, der Ihnen im App Store vor dem Kauf angezeigt wird (in Deutschland derzeit 29,99 € pro Jahr, inkl. USt.).

Das Abonnement verlängert sich um jeweils ein Jahr, sofern es nicht spätestens 24 Stunden vor Ende der laufenden Periode gekündigt wird. Die Abrechnung erfolgt über Ihre Apple-ID innerhalb von 24 Stunden vor Beginn der neuen Periode.

Die Kündigung erfolgt in den Einstellungen Ihrer Apple-ID (apps.apple.com/account/subscriptions) oder in der App unter „Einstellungen → LearnDeck Pro → Abo verwalten“. Der Anbieter kann Abonnements nicht selbst kündigen.

Nach einer Kündigung bleibt der Zugang bis zum Ende der bezahlten Periode erhalten. Eine Rückerstattung für die bereits laufende Periode findet nicht statt; über Erstattungsanträge entscheidet ausschließlich Apple.

Familienfreigabe: Das Abonnement lässt sich über die Familienfreigabe von Apple mit bis zu fünf weiteren Mitgliedern derselben Familiengruppe teilen. Diese Mitglieder erhalten denselben Funktionsumfang; Verwaltung und Kündigung bleiben ausschließlich dem Apple-Account vorbehalten, der das Abonnement gekauft hat. Endet das Abonnement oder die Freigabe, gelten für die Mitglieder wieder die Grenzen der kostenlosen Version, während ihre eigenen Inhalte unverändert erhalten bleiben.

5. Widerrufsrecht

Für Verbraucher besteht bei digitalen Inhalten ein gesetzliches Widerrufsrecht. Da der Kauf über den App Store abgewickelt wird, ist der Widerruf gegenüber Apple zu erklären; das Verfahren richtet sich nach den Bedingungen von Apple für Medien und Dienste.

6. Von künstlicher Intelligenz erzeugte Inhalte

Lernkarten, Fragen und Übersetzungen werden automatisiert aus Ihrem eigenen Material erzeugt – auf Geräten mit Apple Intelligence durch ein Sprachmodell auf dem Gerät, sonst durch ein regelbasiertes Verfahren. Automatisch erzeugte Formulierungen können unvollständig, verkürzt oder inhaltlich falsch sein.

Sie prüfen die Inhalte selbst, bevor Sie sich darauf verlassen. Die App ist ein Lernwerkzeug und ersetzt weder eine Quelle noch eine fachliche Prüfung; sie bewertet keine Personen und trifft keine Entscheidungen über Menschen. Karten, die vollständig oder teilweise automatisiert erzeugt wurden, sind in exportierten Backup-Dateien maschinenlesbar als solche gekennzeichnet.

7. Ihre Inhalte und Rechte Dritter

Sie sind dafür verantwortlich, dass Sie das Material, das Sie scannen, importieren oder eingeben, nutzen dürfen. Das Digitalisieren urheberrechtlich geschützter Werke ist nur im Rahmen der gesetzlichen Schranken zulässig. Ihre Inhalte bleiben Ihre – der Anbieter erhält keinen Zugriff darauf.

8. Verfügbarkeit und Systemvoraussetzungen

LearnDeck benötigt iPhone oder iPad mit iOS bzw. iPadOS 26 oder neuer. Die Erzeugung von Karten durch ein Sprachmodell auf dem Gerät setzt zusätzlich Apple Intelligence voraus (iPhone 15 Pro oder neuer; iPad mit M1 oder neuer bzw. iPad mini mit A17 Pro) und dass Apple Intelligence in den Systemeinstellungen aktiviert ist. Auf allen anderen unterstützten Geräten erstellt die App die Karten mit einem regelbasierten Verfahren; der Funktionsumfang bleibt derselbe, die Formulierungen sind einfacher. Diese Voraussetzungen liegen bei Apple und können sich ändern.

9. Haftung

Der Anbieter haftet unbeschränkt für Vorsatz und grobe Fahrlässigkeit sowie bei Verletzung von Leben, Körper und Gesundheit. Bei einfacher Fahrlässigkeit haftet er nur für die Verletzung wesentlicher Vertragspflichten und begrenzt auf den vorhersehbaren, typischen Schaden. Für den Verlust von Daten haftet der Anbieter nur bis zu dem Aufwand, der bei regelmäßiger Sicherung durch Sie zur Wiederherstellung erforderlich gewesen wäre – die App bietet dafür eine Export- und Importfunktion. Eine weitergehende Haftung ist ausgeschlossen.

10. Änderungen dieser Bedingungen

Der Anbieter kann diese Bedingungen anpassen, wenn Funktionen der App sich ändern oder rechtliche Vorgaben es erfordern. Über wesentliche Änderungen wird in der App oder auf dieser Seite informiert.

11. Anwendbares Recht

Es gilt deutsches Recht. Für Verbraucher bleiben zwingende Schutzvorschriften des Staates, in dem sie ihren Wohnsitz haben, unberührt.

1. Provider and scope

These terms govern the use of the LearnDeck app for iOS and iPadOS, offered by 40° GmbH – Labor für Innovation, Marienthaler Straße 17, 24340 Eckernförde, support@learndeck.app.

The purchase agreement for a subscription is concluded with Apple, not with the provider. Apple's Media Services Terms and Conditions apply in addition to the purchase. These terms govern the use of the app itself.

2. Licence

You receive a non-exclusive, non-transferable right to use the app on the devices associated with your Apple ID. The app may not be reverse-engineered, modified, resold or rented. All rights in the software remain with the provider.

3. Free version and LearnDeck Pro

The app is free to use and, in that case, limited in scope:

• 1 collection
• 10 decks
• 5 pages per scanned or imported document

LearnDeck Pro removes these limits. Content you have already created always remains accessible, even after a subscription ends: the limits only apply to creating new content.

4. Subscription, term and cancellation

LearnDeck Pro is an auto-renewing annual subscription. The applicable price is the one shown to you in the App Store before purchase (currently EUR 29.99 per year in Germany, incl. VAT).

The subscription renews for another year unless cancelled at least 24 hours before the end of the current period. Billing runs through your Apple ID within 24 hours before the start of the new period.

Cancel in your Apple ID settings (apps.apple.com/account/subscriptions) or in the app under “Settings → LearnDeck Pro → Manage subscription”. The provider cannot cancel subscriptions on your behalf.

After cancellation, access remains until the end of the period already paid for. There is no refund for the current period; refund requests are decided solely by Apple.

Family Sharing: The subscription can be shared with up to five further members of the same Apple family group through Family Sharing. Those members get the identical feature set; managing and cancelling remain reserved for the Apple Account that bought the subscription. When the subscription or the sharing ends, the free version's limits apply to those members again, while their own content remains untouched.

5. Right of withdrawal

Consumers have a statutory right of withdrawal for digital content. As the purchase is processed through the App Store, withdrawal must be declared to Apple; the procedure follows Apple's Media Services Terms and Conditions.

6. AI-generated content

Flashcards, questions and translations are generated automatically from your own material – by an on-device language model on devices with Apple Intelligence, and by a rule-based process otherwise. Automatically generated wording can be incomplete, abbreviated or factually wrong.

You check the content yourself before relying on it. The app is a study tool and replaces neither a source nor expert review; it does not assess people and makes no decisions about individuals. Cards that were generated automatically, in whole or in part, are marked as such in machine-readable form in exported backup files.

7. Your content and third-party rights

You are responsible for having the right to use the material you scan, import or type in. Digitising copyrighted works is only permitted within the statutory exceptions. Your content remains yours – the provider has no access to it.

8. Availability and system requirements

LearnDeck requires an iPhone or iPad running iOS or iPadOS 26 or later. Generating cards with an on-device language model additionally requires Apple Intelligence (iPhone 15 Pro or newer; iPad with M1 or newer, or iPad mini with A17 Pro) and Apple Intelligence being enabled in the system settings. On all other supported devices the app creates cards using a rule-based process; the feature set stays the same, the wording is simpler. These requirements are set by Apple and may change.

9. Liability

The provider is liable without limitation for intent and gross negligence and for injury to life, body or health. In cases of ordinary negligence, liability is limited to the breach of material contractual obligations and to the foreseeable, typical damage. For loss of data, liability is limited to the effort that would have been required for recovery had you kept regular backups – the app provides an export and import function for this purpose. Any further liability is excluded.

10. Changes to these terms

The provider may adapt these terms when the app's functionality changes or legal requirements make it necessary. Material changes will be announced in the app or on this page.

11. Governing law

German law applies. For consumers, the mandatory protective provisions of their country of residence remain unaffected.
